Terms of Use

1. The basics

These terms ("Terms") cover your use of the Pecki app and related services (together, "the Service"), provided by Pecki ("we", "us"). By signing in or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use Pecki.

Our Privacy Policy is part of these Terms — it explains what we do with your data.

2. Who can use Pecki

You need to be at least 13 (or 16 in some EU countries) and able to enter a contract under your local law. If you're using Pecki for a business, you confirm you have the authority to bind that business.

3. Your account

You sign in with Apple or Google. Keep your sign-in secure, watch for anything you didn't do, and tell us if you think someone else got in. Anything done with your account is treated as you.

4. Free and Pecki Pro

Free

The free plan lets you keep a catalogue of items, count sales during the day, and settle the day. Settled days live on your phone for 3 days and then go away — they're never sent to our servers.

Pecki Pro

Pecki Pro saves your settled days to our servers so you can:

• See your full history across all your devices
• Keep your records as long as your subscription is active
• Export your records as a CSV file
• Use any future Pro features we add

Free → Pro within 3 days

If you upgrade to Pro within 3 days of a free settle, that settled day is moved from your phone to our servers and kept like any other Pro record.

If your Pro lapses

If your subscription ends (cancelled, didn't renew, payment failed), your old Pro records are kept for 30 more days. Resubscribe in that window and they come back. Wait longer than 30 days and they're permanently deleted by an automatic cleanup.

5. Subscriptions and billing

Plans

Pecki Pro comes as a monthly auto-renewing subscription or an annual auto-renewing subscription. Current prices appear in the app at purchase.

Payment

Apple (App Store) and Google (Google Play) handle all payments under your existing terms with them. Your Apple ID or Google account is charged at confirmation of purchase. We don't see your card details.

Auto-renewal (the part Apple makes us tell you)

Your subscription renews automatically at the end of each billing period unless you turn off auto-renew at least 24 hours before the end of the current period. You'll be charged for renewal within 24 hours before the period ends, at the renewing subscription's price. Manage or cancel via Apple ID → Subscriptions or your Google account.

Refunds

Refunds are handled by Apple or Google under their refund policies. We can't issue refunds directly for store-billed subscriptions — please go through Apple or Google.

6. Your stuff

The items, prices, and sales you record in Pecki are yours. You give us a basic licence to store, sync, and show that data back to you so the app works — that's it. We don't claim ownership, we don't use it for ads, and we don't train AI on it.

7. Don't do these

Please don't:

• Reverse-engineer or try to extract Pecki's source code
• Use Pecki for anything illegal
• Use Pecki to harass, defraud, or harm anyone
• Try to get into our systems or other users' accounts
• Resell or redistribute Pecki without our written permission
• Run bots or scrapers that mess with normal operation

If you do any of these, we may suspend or terminate your account.

8. Service availability

We try hard to keep Pecki working, but we can't promise it'll always be up or perfect. The app is provided "as is". We may change, pause, or discontinue parts of the Service with whatever notice is reasonable. If we shut Pecki down entirely, we'll give you reasonable notice and a way to export your data first.

9. Intellectual property

The Pecki app, name, and visual mark belong to us. We give you a limited, personal, non-transferable licence to install and use Pecki — that's all. Open-source components inside Pecki keep their own licences; ask support@peekingowl.com for the list.

10. Disclaimers

TO THE MAXIMUM EXTENT THE LAW ALLOWS, PECKI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH NO WARRANTIES — INCLUDING NO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF ANY DATA. WE DON'T GUARANTEE THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT YOUR DATA WON'T BE LOST.

Keep your own backups of anything important — Pro users can export to CSV inside the app any time. Nothing here removes a right or remedy your local consumer law gives you that we can't waive.

11. Limitation of liability

TO THE MAXIMUM EXTENT THE LAW ALLOWS, WE'RE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY TO YOU FOR ANYTHING ARISING FROM THESE TERMS OR YOUR USE OF PECKI IS CAPPED AT THE GREATER OF (A) WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) FIVE U.S. DOLLARS.

Some places don't allow these limits — in those places, our liability is limited to the smallest amount the law allows.

12. Export compliance

You may not use Pecki if you are located in, under the control of, or a national or resident of any country embargoed by the U.S. or Philippine government, or if you are on any U.S. government list of prohibited or restricted parties (including the Treasury Department's list of Specially Designated Nationals or the Commerce Department's Denied Persons or Entity List). By using Pecki, you represent and warrant that none of the above applies to you.

13. Indemnity

If a third party brings a claim against us because you broke these Terms or misused Pecki, you'll cover our reasonable costs (including legal fees). This doesn't apply if the issue is our fault or where local consumer law doesn't allow this.

14. Ending things

You can end these Terms any time by deleting your account from Settings → Delete account in the app, or just by no longer using Pecki.

We can suspend or end your access if you seriously break these Terms, if the law tells us to, or if we shut Pecki down. Once your access ends, the disclaimers, liability limits, IP, indemnity, and governing law sections still stick around.

15. App Store / Google Play notes

If you got Pecki from the Apple App Store: these Terms are between you and us only — not Apple. Apple has no obligation to maintain or support Pecki. Apple isn't responsible for handling your claims about Pecki. Apple and its subsidiaries are third-party beneficiaries of these Terms and can enforce them.

If you got Pecki from Google Play, the equivalent applies for Google to the extent set out in their developer distribution agreement.

16. Changes to these Terms

If we change these Terms in a meaningful way, we'll tell you in the app or by email before the change takes effect, and bump the "Last updated" date. Continuing to use Pecki after the change means you accept the new Terms. If you don't, you can delete your account before the change kicks in.

17. Governing law

These Terms are governed by the laws of the Republic of the Philippines, where Pecki is based. Disputes go to the courts of the Philippines, unless local rules in your country say otherwise.

Nothing here removes the consumer protections you have under your local law (including in the EU, UK, California, and the Philippines).

18. Other bits

These Terms (with the Privacy Policy) are the whole deal between you and us about Pecki. If we don't enforce something straight away, that doesn't mean we've given it up. If a court strikes one part out, the rest still applies. You can't transfer your rights under these Terms without us agreeing in writing; we can.
